Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the WYNTEK platform, including our website (wyntek.tech), web application, and associated services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Account Responsibilities
To use most features of the Service, you must create an account. You are responsible for:
- Providing accurate, current, and complete information during registration and keeping it up to date.
- Maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
- Notifying us immediately at contact@wyntek.tech if you suspect unauthorized access to your account.
- Not sharing your account with others or creating accounts on behalf of third parties without authorization.
You must be at least 18 years old to create an account. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2. Token Purchase Policy
The WYNTEK platform uses a prepaid token system. Tokens are purchased in advance and consumed when you submit fabrication jobs.
- Non-refundable — all token purchases are final and non-refundable by default. Tokens have no cash value and cannot be transferred to another account.
- Exceptions — at our sole discretion, we may issue refunds or token credits in cases of verified platform errors, duplicate charges, or service failures directly attributable to WYNTEK. To request a review, contact contact@wyntek.tech within 14 days of the purchase.
- Job cancellation — if a job is cancelled before work begins, the tokens consumed will be returned to your balance. Once fabrication has started, consumed tokens are not returned.
- Token expiry — tokens do not expire while your account is active. Upon account termination, unused tokens are forfeited.
- Pricing — token prices and job costs are subject to change. We will provide at least 14 days' notice before any price changes take effect.
3. Intellectual Property
Your designs: You retain full ownership of all CAD files, drawings, and design data you upload to the platform. By uploading files, you grant WYNTEK a limited, non-exclusive license to access and use your files solely for the purpose of fulfilling your fabrication jobs. We will not reproduce, distribute, or disclose your designs to third parties except as required to complete your job (e.g., sending specifications to an in-house operator).
WYNTEK platform: The WYNTEK platform, including its software, design, branding, content, and documentation, is owned by WYNTEK and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the platform without our express written permission.
User responsibility: You represent and warrant that you own or have the right to upload all files you submit through the Service, and that doing so does not infringe any third-party intellectual property rights. You are solely responsible for any IP infringement claims arising from your uploaded content.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Submit designs or request fabrication of any item that is illegal under applicable law, including but not limited to weapons, controlled devices, or products prohibited for export.
- Attempt to gain unauthorized access to any part of the platform, other users' accounts, or our infrastructure.
- Transmit malware, viruses, or any code designed to disrupt, damage, or gain unauthorized access to our systems.
- Use the platform in any way that could damage, overburden, or impair the Service or interfere with other users' use.
- Scrape, harvest, or collect data from the platform without our express written consent.
- Misrepresent your identity, affiliation, or the nature of your fabrication requests.
We reserve the right to investigate any suspected violation of this section and to take appropriate action, including suspending or terminating your account.
5. Service Availability
We aim to keep the WYNTEK platform available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice where possible).
- Unplanned outages or infrastructure issues.
- Equipment downtime, repairs, or capacity constraints in the physical lab.
- Force majeure events outside our reasonable control.
Job timelines stated at submission are estimates and not guaranteed. If a delay significantly exceeds the stated timeline due to circumstances within our control, we will notify you promptly and work to provide a fair resolution.
6. Limitation of Liability
To the maximum extent permitted by applicable law, WYNTEK and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or costs of substitute goods or services, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount you paid to WYNTEK in the 90 days preceding the event giving rise to the claim.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose or merchantability. We do not warrant that fabricated parts will be free from defects, though we are committed to quality and will work with you to address legitimate quality concerns.
7. Termination
By you: You may terminate your account at any time by contacting us at contact@wyntek.tech. Upon termination, your access to the platform will be revoked and any unused tokens will be forfeited.
By WYNTEK: We may suspend or terminate your account immediately, without notice or liability, if we determine (at our sole discretion) that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the platform or other users.
Upon termination for any reason, all provisions of these Terms that by their nature should survive will survive, including intellectual property provisions, limitation of liability, and any payment obligations for jobs already in progress.
8. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction. We will always try to resolve issues fairly and directly before escalating to formal proceedings.
9. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice in the platform. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service.
